OLD LYME ZONING COMMISSION
PUBLIC HEARING
Monday, August 10, 2009


The Old Lyme Zoning Commission held a Public Hearing on Monday, August 10, 2009, at 7:30 p.m. in the Auditorium of Memorial Town Hall.  Those present and voting were Jane Cable, Acting Chairman, Jane Marsh, Secretary, John Johnson, Patrick Looney, Beth Sullivan (alternate) and Ted Kiritsis (alternate).    Also present were Ann Brown, Zoning Enforcement Officer and Eric Knap, Commission Counsel.

Acting Chairman Cable called the Public Hearing to order at 7:32 p.m.  Ms. Marsh read the legal notices for the two Public Hearings, as advertised in the New London Day on Tuesday, July 28 and Tuesday, August 4, 2009.

1.      287 Shore Road, Shoreline Church, Inc., applicant.

Acting Chairman Cable stated that the applicant has requested that this Public Hearing be opened this evening and no testimony be taken.  She indicated that the Public Hearing for this item will be continued to the September 14, 2009, Regular Meeting.

A motion was made by Jane Marsh, seconded by Patrick Looney and voted unanimously to open the Public Hearing, and to continue the Public Hearing to the September 14, 2009 Regular Meeting without taking any testimony.

2.      Petition to amend the Old Lyme Zoning Regulations, Definition of Height in the Gateway Zone, Old Lyme Zoning Commission, applicant.

Ms. Marsh read the exhibit list for the record.  She noted that they have not yet received a response from the Planning Commission.  Acting Chairman Cable explained that because the Town of Old Lyme is a member of Gateway, they are obligated to adopt the Gateway Regulations, which includes the proposed definition of height in the Gateway Zone.

Ms. Cable read the existing definition of height and the proposed amendment.  She noted that the proposal requires determination of the building height from the original existing, natural grade.

Ms. Marsh stated that the Gateway Zone includes land within 1,000 feet of the Connecticut River.

Acting Chairman Cable noted that the Gateway Commission voted to approve this amendment; the Office of Long Island Sound Programs finds the proposal consistent with the Coastal Area Management Act; Zoning Board of Appeals has no comment; and the Regional Planning Agency did not have a quorum at their meeting.

A motion was made by John Johnson, seconded by Patrick Looney and voted unanimously to continue the Public Hearing for the Petition to amend the Old Lyme Zoning Regulations, Definition of Height in the Gateway Zone, Old Lyme Zoning Commission, applicant, to the September 14, 2009 Regular Meeting.

Acting Chairman Cable adjourned the Public Hearing at 8:00 p.m.
